2. Scope
These terms govern web hosting, Cloud VPS and business email services ordered through smartbytes.cloud, together with related support.
Greek and European law on electronic commerce, consumer protection and telecommunications applies.
3. Formation of the contract
Orders are placed through the online order form. Payment is taken on submission, but the contract is formed and the service activated only after our team reviews and approves the order.
You receive two emails: confirmation that the order was received, and your login details once the account is active.
We may decline an order, in particular where fraud or a breach of the Acceptable Use Policy is suspected. In that case the full amount is refunded.
4. Prices, VAT and invoicing
Prices are in euro and exclude VAT. Greek VAT at 24% is calculated and added at checkout.
A lawful tax document is issued for every transaction. If you need a business invoice, give us your company name and VAT number at checkout or straight afterwards at info@smartbytes.cloud.
Prices may change. Any change is announced at least thirty (30) days before your next renewal and never affects the current billing period.
5. Payments
Payments are processed by Stripe Payments Europe, Ltd. We never receive or store your card details at any point.
6. Term, automatic renewal and cancellation
Subscriptions renew automatically at the end of each billing period, monthly or annually as chosen, charging the same payment method.
You may cancel at any time, without penalty, by emailing info@smartbytes.cloud. Cancellation takes effect at the end of the current period: the service stays active until then and no further charge is made.
After termination your data is kept for thirty (30) days so you can retrieve it, then permanently deleted.
7. Right of withdrawal
As a consumer you have fourteen (14) calendar days from conclusion of the contract to withdraw, without giving reasons.
At checkout you are asked to expressly request immediate performance. Under Directive 2011/83/EU and Greek law 2251/1994, once the service has been fully performed with your express consent, the right of withdrawal is lost for the part already supplied.
In practice: before activation you are entitled to a full refund. After activation, you are charged pro rata for the period used.
8. Refunds
- Order not approved or declined: full refund.
- Withdrawal before activation: full refund.
- Withdrawal within 14 days after activation: refund less the pro-rata value of days used.
- SLA breach attributable to us: credit as set out in the SLA section.
Refunds are returned to the original payment method within fourteen (14) days of the request being accepted.
9. Availability guarantee (99.99% SLA)
We guarantee 99.99% monthly availability at the level of the data centre network and hardware.
Scheduled maintenance, announced at least forty-eight (48) hours in advance, force majeure, attacks directed at your own site and faults in your own software or configuration are excluded.
Where a shortfall is documented and claimed within thirty (30) days, a credit equal to 10% of the monthly subscription for each full hour of downtime beyond the guarantee, capped at the monthly subscription, is applied to your next invoice.
10. Your obligations
- Provide accurate contact and billing details.
- Keep your credentials safe; you are responsible for activity under your account.
- Change the initial password on first login.
- Keep any software you install, especially CMS platforms and plugins, up to date.
- Remain responsible for the content you host and its lawfulness.
11. Acceptable use
The following are prohibited:
- Unsolicited bulk email (spam) or mass messaging without documented recipient consent.
- Hosting or distributing malware, phishing pages or unlawful content.
- Cryptocurrency mining and any activity consuming disproportionate resources.
- Infringement of third-party intellectual property rights.
- Anything that endangers the stability or security of the infrastructure or the reputation of our IP addresses.
12. Backups
Automatic daily backups are kept on storage independent of the hosting server, as stated for each plan.
Backups are a disaster-recovery measure and do not replace your own responsibility to keep copies. We recommend maintaining an independent copy of critical data.
13. Suspension and termination
We may suspend or terminate the service for non-payment, breach of the Acceptable Use Policy, or where your account endangers third parties or the infrastructure.
Except in urgent security cases, notice and a reasonable period to remedy are given first.
14. Liability
We provide the services with due care. We are not liable for lost profits, data loss caused by your own acts or omissions, or damage from events beyond our control.
Our total liability per incident is limited to the amount you paid for the service in the twelve (12) months preceding the event.
Nothing in these terms limits rights granted to you by mandatory consumer protection law.
15. Personal data
Processing of your data is described in our Privacy Policy, which forms part of these terms.
16. Changes to these terms
These terms may change. Material changes are announced by email at least thirty (30) days in advance. If you disagree, you may terminate without charge before they take effect.
17. Governing law and disputes
Greek law applies. The courts of Trikala have jurisdiction, without prejudice to a consumer's right to bring proceedings where they live.
